Terms of Service

These Terms of Service ("Terms") govern your use of PeakFlow software and services ("Service") operated by PeakFlow ("we", "our", or "us"). By downloading or using any PeakFlow tool, you agree to these Terms.

1. Description of Service

PeakFlow provides a suite of Windows desktop productivity tools available through a monthly subscription. The Service includes:

• Downloadable Windows applications (the "Tools")
• Access to future tools released during your subscription
• Software updates and bug fixes

2. Free Trial

PeakFlow offers a 7-day free trial of all Tools. No credit card is required to start a free trial. After the trial period, you must subscribe to continue using the Tools.

3. Subscription & Payment

• The PeakFlow Pro subscription costs $5.00 USD per month.
• Payment is processed by our third-party payment provider.
• Your subscription automatically renews each month unless cancelled.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We do not offer refunds for partial months.

4. License

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the Tools on your personal Windows PC(s)
• Use the Tools for personal or professional productivity purposes

You may not:

• Redistribute, resell, or sublicense the Tools
• Reverse engineer, decompile, or disassemble the Tools
• Remove or modify any proprietary notices
• Use the Tools for any unlawful purpose
• Share your subscription credentials with others

5. Third-Party Services

Some Tools integrate with third-party services (e.g., Google Calendar, Todoist). Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

6. Intellectual Property

All Tools, including their code, design, and branding, are the intellectual property of PeakFlow. Your subscription grants a usage license only — it does not transfer ownership of any intellectual property.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Fitness for a particular purpose
• Uninterrupted or error-free operation
• Compatibility with all Windows configurations

8. Limitation of Liability

To the fullest extent permitted by law, PeakFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes to active subscribers.

10. Termination

We may terminate or suspend your access to the Service immediately if you violate these Terms. Upon termination, your license to use the Tools ends and you should uninstall them from your PC.

11. Changes to Terms

We may update these Terms from time to time. We will notify subscribers of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of New Zealand.
